Terms of Service
Kavi Media, Inc.
Version 1.0 — Effective 20 October 2026
Published at kavi.audio/legal/terms
In short (not part of the Terms):
- Kavi is a Telugu audio service for adults (18+) who live in the United States or India.
- You get 3 hours of free listening per account, for life. No card is needed for it, and it never turns into a paid plan by itself.
- Premium costs US$6.99 a month or US$54.99 a year in the US, and ₹149 a month or ₹1,249 a year in India. It renews automatically until you cancel.
- You can cancel online at any time. You keep Premium until the end of the period you paid for.
- Refunds are considered case by case, and only if you ask within 7 days after your paid plan starts, unless the law gives you more.
- Premium is not ad-free. A creator may include one sponsor spot per episode, which Kavi approves first, but never in family content. Kavi sells no ads today. If it starts, it will tell you at least 30 days before.
- Your profile name, photo and bio are public on the web.
- Follow the Community Guidelines, and post only what you have the right to post.
- US disputes go to individual arbitration unless you opt out of arbitration within 30 days (section 24). Class actions are waived either way: the class action waiver still applies in court if you opt out, as far as the law allows. People in India can always go to a Consumer Commission.
1. About these Terms
1.1 These Terms of Service (the "Terms") are an agreement between you and Kavi Media, Inc. ("Kavi", "we", "us").
- Kavi is a Delaware corporation.
- Its principal place of business is in Alpharetta, Georgia, USA.
- Its mailing address is 169 Madison Ave STE 30314, New York, NY 10016, USA.
1.2 These Terms govern your use of the Kavi audio streaming service: the website kavi.audio, the Kavi mobile apps and any other Kavi listening service that links to these Terms (the "Service"). The Service offers Telugu-language podcasts, audio shows, audiobooks, music, readings and short audio items called "Bites".
1.3 How you accept. You accept these Terms when you create a Kavi account by ticking the box that says you accept the Terms of Service and Privacy Policy. That box is never ticked for you. Kavi keeps a record of which version you accepted and when.
1.4 Other documents that form part of these Terms. The following documents form part of these Terms. Each is published at its link. (a) The parts of the Community Guidelines (kavi.audio/legal/community-guidelines) that section 11.2 lists, as they apply to listeners. (b) The Copyright/DMCA and Repeat-Infringer Policy (kavi.audio/legal/copyright-policy), sections 4 to 8, as they apply to listeners (section 14).
These documents explain how Kavi handles your personal data. They are not contracts you sign, but you should read them: (c) the Privacy Policy (kavi.audio/legal/privacy-policy); (d) the Cookie Policy (kavi.audio/legal/cookie-policy); and (e) the Consumer Health Data Privacy Policy (kavi.audio/legal/consumer-health-data-privacy-policy).
1.4A Changes to the documents in section 1.4(a) and (b). Those documents are written mainly for creators and can change under the creator agreements. A change to a part of them that forms part of these Terms takes effect for listeners only as section 19.2 provides.
1.5 What these Terms replace. These Terms replace Kavi's earlier Terms of Service and its Subscription Billing & Cancellation Policy. The rules on subscriptions, billing, renewal, cancellation and refunds are now in sections 4 to 9 of these Terms.
1.6 Language. These Terms are in English. Kavi will publish a Telugu translation by 13 May 2027. If the two versions differ, the English version applies, unless the law that protects you as a consumer says otherwise.
1.7 If you have signed an agreement with Kavi. Section 23 explains how these Terms relate to any agreement you have signed with Kavi as a creator, contributor or affiliate.
2. Who can use Kavi
2.1 Adults only. You must be at least 18 years old to create a Kavi account, to have a profile, or to buy a subscription. When you sign up, Kavi asks for your date of birth.
2.2 United States and India only. Kavi is offered only to people who live in the United States or India. Prices, taxes and some rules in these Terms depend on which of the two countries you live in. Some content may not be available in both countries.
- Do not give a false location or address.
- Do not use a VPN or any other tool to buy a plan priced for a country you do not live in.
- Do not use any other tool to make it look as if you live somewhere you do not.
2.3 True information. The information you give Kavi must be true, and you must keep it up to date. This includes your name, email address, date of birth and country.
2.4 One account per person. You may hold only one Kavi account. Do not create extra accounts to get more free listening time or to avoid a suspension.
2.5 App-store age information. You may download a Kavi app from an app store. If that store gives Kavi information about your age range, Kavi uses it only to check that you are eligible and to comply with the law. Kavi uses it for nothing else.
2.6 If you live outside the US or India. You may not create an account or buy a subscription if you live in another country. If Kavi learns that an account belongs to someone who is not eligible, it may close that account under section 16.
3. Your account and profiles
3.1 Your account. Your Kavi account is linked to your email address.
- Keep your password safe.
- Do not share your login with anyone outside the profiles on your account.
- Tell Kavi at privacy@kavi.audio if you think someone else has used your account.
You are responsible for activity on your account. This does not cover activity caused by Kavi's own failure.
3.2 Profiles. A "profile" is a separate listening identity within your account. Each profile has its own name, listening history and recommendations.
- A free account has one profile.
- A Premium account can have more than one profile, up to the number the plans page and checkout show for your plan (at most 4).
- Each extra profile needs the details the app asks for, including a name, date of birth and email address.
- You are responsible for how every profile on your account is used.
3.3 Every profile is for an adult. Each profile must be used by one person who is at least 18 years old. Kavi has no children's profiles. Do not create a profile for anyone under 18.
3.4 Family content.
- Kavi carries some content labeled as suitable for family listening ("family content"). Family content is chosen and played by adults, on the adult's own profile. Kavi markets it to adults.
- Kavi does not knowingly collect personal information from children under 13 (Privacy Policy, section 15).
- Kavi does not place advertising in family content, and does not allow creator sponsor spots or sponsored Bites in it.
- Whether content is suitable for a particular listener is for the adult to decide.
3.5 Parental controls. Under US law (47 U.S.C. §230(d)), Kavi tells you that parental control protections are commercially available. These include computer hardware, software and filtering services, and they may help you limit access to material that is harmful to minors. Current providers include:
- the parental controls built into Apple devices (Screen Time); and
- Google's Family Link for Android devices.
The US Federal Trade Commission publishes information about parental controls at consumer.ftc.gov/search-terms/parental-control.
3.6 What others can see. Kavi is a public listening community. (a) Your profile name, photo and bio are public. Anyone can see them on the web, including people who are not logged in to Kavi. (b) If you follow a creator, that creator can see your profile name and photo in their list of followers. (c) Creators see summary statistics about their audience, such as age range, gender, country and the times people listen. These statistics are built from the information on listeners' profiles. They do not show any listener's name. (d) Your listening history, your playlists and your email address are not shown publicly.
Choose a profile name, photo and bio you are happy for anyone to see. The Privacy Policy explains more.
4. Free listening
4.1 What you get. Every Kavi account gets 3 hours of free listening in total, for the life of the account ("Free Listening"). All profiles on the account share it. You must sign up to play anything, including during Free Listening.
4.2 No payment details and no automatic upgrade. Kavi does not ask for payment details for Free Listening. It never turns into a paid subscription by itself. When the 3 hours are used up, you need Premium to keep listening.
4.3 Free Listening does not reset. Deleting your account and creating a new one with the same email address does not give you a new 3 hours. To make this work, Kavi keeps the amount of free time used in a form tied to a one-way code made from your email address, not the address itself (section 17.3(b)).
4.4 What is not included. Offline downloads and extra profiles are available only with Premium.
5. Premium: plans, prices and taxes
5.1 The plan. Kavi offers one paid plan, "Premium". It is available with monthly or yearly billing. Premium includes: (a) listening to the Kavi catalog without the Free Listening limit; (b) downloading titles to listen offline in the Kavi app (section 10.9); and (c) more than one profile, up to the number shown for your plan on the plans page (at most 4) (section 3.2).
Premium is not ad-free (section 10.4).
5.2 Prices.
| Where you live | Monthly | Yearly |
|---|---|---|
| United States | US$6.99 a month | US$54.99 a year |
| India | ₹149 a month | ₹1,249 a year |
The price you pay depends on the country you live in (section 2.2). The plans page and checkout always show the current price.
5.3 Taxes. (a) United States. US prices do not include sales tax. Where sales tax applies to your subscription, it is calculated for the place where you live and added at checkout. Checkout shows the tax and the total you will pay before you confirm. (b) India. In India, the price Kavi shows is the total you pay. It includes GST and every other compulsory charge.
5.4 Referral discount. You may subscribe through a link or code from a participant in Kavi's Affiliate and Referral Program (section 22). If so, and you have never had a paid Kavi subscription before, you get 5% off each subscription payment for the first 12 months. That is up to 12 monthly payments, or 1 yearly payment. After that, you pay the normal price. Checkout shows the discount before you pay. The person who referred you may earn a commission from Kavi.
5.5 Who processes payments. Kavi takes payment through Stripe, using a checkout page that Stripe hosts. Kavi never sees or stores your full card details. Kavi may add other payment providers later; for example, it may add Cashfree for India. Checkout will show which provider is handling your payment.
5.6 App-store purchases. Kavi may later let you subscribe through the Apple App Store or Google Play. If you do, that store charges you and its billing, cancellation and refund rules apply to that purchase. Sections 6 to 9 still apply to the extent the store's rules allow, and Kavi will explain any differences on the purchase screen.
6. Automatic renewal and billing
6.1 Premium renews automatically. Your Premium subscription renews automatically at the end of each billing period, monthly or yearly, until you cancel. At each renewal, Kavi charges the payment method on file the price for your plan then in effect, plus any applicable tax (section 5.3). The charge is taken at the start of each new period. Section 9 explains how a price can change.
6.2 What Kavi shows you before you pay. Before Kavi asks for your payment details, the subscribe screen shows the following in clear, easy-to-read text directly above the button you press to subscribe: (a) the price and any applicable tax, or for India the tax-inclusive total; (b) how often you will be charged (monthly or yearly); (c) that the subscription renews automatically until you cancel; (d) how to cancel (section 7); (e) the refund policy (section 8); and (f) a link to these Terms.
6.3 Your agreement to renewal. You agree to the renewal terms by an action of your own: by ticking a box that is not ticked for you, or by pressing a button clearly labeled with words such as "Agree and subscribe". Kavi never uses pre-ticked boxes to get your agreement.
6.4 Confirmation email. Right after you subscribe, Kavi (or Stripe for Kavi) emails you a confirmation that you can keep. It always arrives no later than 3 days after your first charge. It sets out: (a) the plan, price and billing frequency; (b) that the plan renews automatically until you cancel; (c) how to cancel, with a direct link; (d) the refund policy; and (e) Kavi's contact details.
6.5 Receipts. Every time you are charged, Kavi (or Stripe for Kavi) emails you a receipt.
6.6 Reminders. (a) Yearly plans. Kavi (or Stripe for Kavi) emails you a reminder 30 days before each renewal. The reminder gives the date and amount of the renewal charge, how to cancel, and a direct link to cancel. (b) Monthly plans. At least once a year, Kavi (or Stripe for Kavi) emails you a reminder that you are still subscribed. It gives your plan, how often and how much you are charged, how to cancel, and a direct link to cancel.
6.7 Payments in India (recurring mandates). (a) If you pay with an Indian card, UPI or another Indian payment method, renewals are collected under a recurring payment mandate (an e-mandate). You set it up with your bank or payment app when you first subscribe. (b) Under Reserve Bank of India rules, your bank or payment app is expected to notify you at least 24 hours before each renewal charge. That notice lets you opt out of that charge or cancel the mandate. (c) Premium prices are below ₹15,000. Under those rules, renewal charges may therefore be collected without a one-time password. (d) You can cancel the mandate in your bank or UPI app as well as in Kavi. Cancelling the mandate stops future payments. If a renewal then cannot be collected, your subscription ends as section 6.8 describes. To end it cleanly, cancel in Kavi as well (section 7).
6.8 If a payment fails.
- If a renewal payment fails, Kavi (through Stripe) may try again over a short period.
- Your Premium access may pause until the payment succeeds.
- If it does not succeed, your subscription ends and your account returns to Free Listening, with whatever Free Listening time it has left.
- Kavi does not charge a fee for a failed payment.
6.9 Records. Kavi keeps a record of:
- the terms shown to you when you subscribed;
- your agreement to them;
- the confirmation it sent you; and
- any cancellation.
It keeps these for at least 3 years, or for 1 year after your subscription ends, whichever is longer. You can ask for a copy at contact@kavi.audio.
7. Cancelling
7.1 Cancel online, at any time. You can cancel Premium online whenever you like. Use Manage Subscription in the settings of the Kavi app, or go straight to kavi.audio/cancel. Both open Kavi's secure billing page, where you can cancel. Cancelling takes effect immediately for future renewals. You do not need to call or email Kavi. Kavi charges no fee to cancel.
7.2 Other ways to cancel. You may also cancel by emailing contact@kavi.audio from the email address on your account, with the words "Cancel my subscription". Kavi confirms by email within 2 business days. If you paid with an Indian payment method, you may also cancel the mandate in your bank or UPI app (section 6.7(d)).
7.3 What happens when you cancel.
- Kavi (or Stripe for Kavi) emails you a confirmation of the cancellation.
- You keep Premium until the end of the period you have already paid for.
- After that, your account returns to Free Listening, and no further charges are made.
- Downloads stop playing when Premium ends (section 10.9).
- Your playlists and listening history stay on your account unless you delete it.
7.4 No obstacles.
- Kavi will not require you to view, listen to or turn down an offer before you can cancel.
- If Kavi ever shows you an offer while you cancel, the option to cancel will stay visible on the same screen the whole time.
- If you live in Minnesota, Kavi will show you such an offer only if you have first agreed to hear it.
- Kavi may ask why you are cancelling. Answering is optional, and you can cancel without answering.
7.5 Deleting your account also cancels. If you delete your account (section 17), Kavi cancels your subscription at the same time. This does not apply if your account includes a creator profile (section 17.2): cancel your subscription separately under this section 7. Deleting your account does not by itself entitle you to a refund. Section 8 decides whether a refund is due.
8. Refunds
8.1 The 7-day window. You may ask for a refund within 7 days after your paid plan starts. For a new subscription, that is the date of your first payment. Kavi considers each request case by case. To ask, email contact@kavi.audio from the email address on your account. Kavi tells you its decision, and the reason if it says no, within 7 days after receiving your request.
8.2 Outside that window. Kavi does not otherwise refund a payment, in whole or in part, including for any unused part of a billing period. Cancelling stops future renewals but does not refund the current period. You keep access until it ends (section 7.3).
8.3 Refunds the law requires. Section 8.2 does not apply where the law requires a refund, for example where the law of your state requires one after a price increase (section 9.3). Nothing in this section 8 limits any refund right the law gives you as a consumer.
8.4 How refunds are paid. An approved refund is paid to the payment method you used. Kavi pays it promptly, and in any case within the time any applicable law or payment rule requires. If you paid with an Indian payment method, that includes Reserve Bank of India rules. Your bank may take a few more days to show it.
9. Price and plan changes
9.1 Notice of a price change. Kavi may change the price of Premium.
- If it does, Kavi (or Stripe for Kavi) emails you at least 7 days, and no more than 30 days, before the new price first applies to you.
- The email says what the new price is and when it applies.
- It also tells you how to cancel, with a direct link.
- A new price applies only from your next renewal after that notice, never to a period you have already paid for.
9.2 Changes to other subscription terms. The same notice rule applies to any other material change to your subscription's terms, such as the billing frequency or how renewal works.
9.3 If you are charged a higher price. Where the law of your state requires it (New York's law does, for example), and you did not agree to the higher price in advance, you may cancel within 14 days after the first charge at the higher price. If you do, Kavi refunds the unused part of that billing period, pro rata.
9.4 Switching between monthly and yearly. If you switch billing frequency, the account page or checkout shows two things before you confirm: when the new plan starts and what you will be charged. Sections 6 to 8 apply to the new plan.
9.5 Promotions. If Kavi offers a discount or promotional price, it will show the terms of the offer before you accept it. Those terms include how long the offer lasts and the price you will pay after it ends.
10. The Service and its content
10.1 Your license to listen. Subject to these Terms, Kavi gives you a personal, non-exclusive, non-transferable, revocable license. It lets you:
- stream and listen to the content on the Service; and
- download content in the Kavi app where the Service allows it.
The license is for your own personal, non-commercial use only. "Kavi Content" means everything on the Service, including content made by creators, Kavi's own content, artwork, text and software. Kavi and its licensors (including creators) own the Kavi Content. These Terms give you no ownership of it.
10.2 Content changes. The catalog changes over time.
- Titles may be added, edited or removed, for example when a license ends, a creator withdraws a title, or the law or a takedown requires removal.
- Kavi does not promise that any particular title will stay available.
- Kavi does not promise how often new episodes will be released.
10.3 Creators' views are their own. Kavi Content includes podcasts, shows, news and commentary by independent creators. Views expressed in content are the creators' and their guests', not Kavi's. Content about health, law, money or other specialist subjects is general information only. It is not professional advice for your situation.
10.4 Premium is not ad-free. Kavi does not promise an ad-free experience on any current plan. (a) Creator sponsor spots. A creator may include sponsor messages they have sold themselves:
- at most one sponsor spot per episode or one-off title;
- Kavi approves each spot in advance; and
- the spot must be clearly disclosed.
Kavi shows a "Paid partnership" label (or an equivalent label) on the listing. Creators may also include their own disclosed sponsorships in Bites. (b) Kavi sells no ads today. At the date of these Terms, Kavi does not sell advertising or play ads it has sold. (c) Ads Kavi may add later. Kavi may later play advertising it sells, such as ad breaks before, during or after content. If it decides to, Kavi will give you at least 30 days' notice by email and on the Service before the first such ad plays. If you are subscribed when that change takes effect and you do not want ads, you may cancel under section 7. Section 8 decides whether a refund is due. (d) A future ad-free plan. Kavi may later offer a separate plan without advertising. If it does, the plans page will say exactly what that plan excludes. (e) Kavi's own promotions. Kavi may show you messages about its own Service, plans and content. These are not paid advertising.
10.5 Synthetic voices and labels. (a) Kavi may offer dubbed or translated versions of some content, voiced by a different person or by a synthetic voice. A version voiced by a stock synthetic voice that is not modeled on any real person is labeled "Translated with a synthetic voice". A version voiced by a Kavi Voice (an AI-generated voice Kavi builds, with their consent, from a voice actor who licenses it to Kavi) is labeled "Translated with a synthetic voice (Kavi Voice)", and other content voiced by a Kavi Voice says so on its listing. (b) Audiobooks narrated wholly or partly by an AI voice are labeled "Digitally narrated" and open with a spoken announcement that the audiobook is read by an AI-generated voice. (c) Content that contains an AI replica of a real person's voice, made with that person's consent, is labeled as such on its listing. (d) Content that contains other AI-generated or AI-altered audio is labeled as such. (e) Kavi never presents a synthetic voice as a human voice. (f) You must not remove or hide these labels, for example in any clip you share.
The AI and Synthetic Content Policy (kavi.audio/legal/ai-synthetic-content-policy) explains Kavi's labels.
10.6 Recommendations. Kavi uses your listening activity and the interests you choose to recommend content and to personalize the Service. The Privacy Policy explains how.
10.7 Ratings and age labels. Kavi may label content with an age classification or content warnings. Labels are a guide, not a guarantee. You decide what is right for you and for anyone listening with you.
10.8 Availability. Kavi works to keep the Service running, but it may be unavailable at times, for example during maintenance, outages or events outside Kavi's control. Kavi may change, add or remove features as section 19 describes.
10.9 Downloads.
- Downloads are available with Premium.
- They play only in the Kavi app, and only while your Premium subscription is active.
- Kavi may make a downloaded title unplayable if it is removed from the Service.
- Downloads are stored on your device. Deleting your Kavi account does not remove them; uninstall the app or clear its data to do that.
11. Rules for using Kavi
11.1 What you must not do. When you use the Service, you must not: (a) copy, record, rip, download outside the app's download feature, redistribute, sell, rent, broadcast, publicly perform or publicly play any Kavi Content, except as the Service itself allows (for example, its share feature); (b) get around, disable or interfere with any security, access or copy-protection feature, including signed or time-limited links; (c) use bots, scrapers, scripts or other automated means to access the Service or collect content or data from it; (d) use any Kavi Content, or data collected from the Service, to train, fine-tune or test any artificial intelligence or machine-learning model, or to build a dataset, unless Kavi agrees in writing; (e) inflate, fake or manipulate plays, listens, follows, likes, votes or other activity, for yourself or anyone else, including by repeated automated playback or by offering or accepting rewards for streams; (f) create multiple accounts, share a login outside your own profiles, or resell or transfer access to your account; (g) give false information, impersonate any person or organization, or misrepresent your age or where you live; (h) harass, threaten, bully or abuse any creator, listener or Kavi staff member, including through your profile, playlist names or covers; (i) upload or link to viruses or other harmful code, or try to gain unauthorized access to the Service, other accounts or Kavi's systems; (j) reverse engineer, decompile or disassemble the Kavi apps or software, except where the law allows it despite this restriction; (k) use the Service for any unlawful purpose, or in a way that breaks the law of the country you live in; (l) post, upload or share anything section 12 prohibits, including anything that sexualizes or endangers a child; or (m) help or encourage anyone else to do any of these things.
11.2 Listener conduct and the Community Guidelines. Your rules of conduct as a listener are section 11.1 and section 12 of these Terms. The Community Guidelines (kavi.audio/legal/community-guidelines) are written for creators and, by their own terms (their section 2.1), apply to creators. They also set Kavi's standards for content, so these Terms make the following parts of them part of these Terms for listeners. They apply to everything you post or submit on Kavi (section 13) and to how you behave on the Service:
- section 4 (prohibited content); and
- section 7 (child safety), as it applies to listeners.
Kavi does not yet have an in-app report tool. Where the Guidelines mention one, use the email routes in section 14.1. Complaints to the Grievance Officer follow section 25 of these Terms. If those Guidelines and these Terms differ on listener conduct, these Terms apply.
12. Content that is not allowed (including India's IT Rules)
12.1 Prohibited content. You must not post, upload, share or display, in your profile, playlists, covers, votes, suggestions or anywhere else on the Service, any information that: (a) belongs to another person and that you have no right to use; (b) is obscene, pornographic or paedophilic; (c) invades another person's privacy, including their bodily privacy; (d) insults or harasses anyone on the basis of gender; (e) is racially or ethnically objectionable; (f) relates to or encourages money laundering or gambling; (g) is an online game that causes harm to users; (h) promotes enmity between groups on grounds of religion, caste or otherwise, with the intent to incite violence; (i) is harmful to children; (j) infringes any patent, trademark, copyright or other proprietary right; (k) deceives or misleads anyone about where a message came from, or knowingly and intentionally communicates information that is patently false or misleading; (l) impersonates another person, including through an AI-generated or altered image, voice or likeness; (m) threatens the unity, integrity, defense, security or sovereignty of India, India's friendly relations with other countries, or public order; incites any offense; prevents the investigation of any offense; or insults another nation; (n) contains a software virus or any other computer code, file or program designed to interrupt, destroy or limit the functioning of any computer resource; (o) is an online game that is not permitted under Indian law, or advertises or promotes one, or is surrogate advertising for one; or (p) breaks any law in force.
This list includes the categories in Rule 3(1)(b) of India's Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, as amended (the "IT Rules"). If those rules change, Kavi applies them as in force.
12.2 What can happen if you break these rules. If you post or share prohibited content, Kavi may:
- remove it or disable access to it;
- suspend or end your access to the Service, or close your account (section 16);
- keep records of it; and
- report it to law enforcement or other authorities where the law requires or allows.
Breaking these rules may also be a crime or give rise to legal liability. In India this can include offenses under the Information Technology Act, 2000 and the Bharatiya Nyaya Sanhita, 2023.
12.3 Reminders. Kavi reminds users in India, at least once every three months, of:
- these rules;
- the Privacy Policy; and
- what can happen if the rules are broken (removal, suspension and account closure).
13. Your submissions
13.1 What a submission is. Listeners can add a few things of their own to Kavi (each a "Submission"):
- your profile name, photo and bio;
- the names, descriptions and cover images of your playlists;
- your votes, where the Service offers voting; and
- suggestions and feedback you send Kavi, for example by email to contact@kavi.audio.
Listeners cannot upload audio.
13.2 You keep ownership. As between you and Kavi, you own your Submissions, or your licensors do. These Terms do not transfer or assign ownership of any Submission to Kavi.
13.3 The license you give Kavi. For each Submission, you give Kavi a non-exclusive, worldwide, royalty-free license to:
- host, store, copy, reformat, display and make it available on the Service;
- use it to run, secure, improve and promote the Service; and
- for votes, use them in aggregate (for example, to count results).
Kavi may let its service providers use a Submission only to provide services to Kavi. This license does not let Kavi sell your Submission, or use your photo or name to suggest that you endorse any product, brand or cause.
13.4 How long the license lasts. (a) The license for a profile photo, bio, playlist name, description or cover ends when you delete or replace it, or delete your account. (b) After that, Kavi may still keep copies:
- in backups, until they are overwritten in the normal backup cycle;
- where the law requires it or to deal with a legal claim; and
- where the Submission has already been combined into aggregate counts (for example, a vote). (c) Suggestions and feedback are different. Kavi may use them, without paying you or owing you anything, to improve and develop its services. You give Kavi a license to do so that continues after you delete your account. Kavi does not have to use any suggestion.
13.5 Your promises. For each Submission, you promise that:
- you own it or have every right needed to give Kavi the license in section 13.3;
- it does not infringe anyone's copyright or other rights;
- it does not break section 12 or the law; and
- any photo of another person is used with that person's permission.
13.6 Copyright indemnity. (a) What you agree to. If a third party makes a claim against Kavi that a Submission you posted infringes their copyright, you will compensate Kavi for:
- the amounts Kavi has to pay on that claim; and
- its reasonable legal costs of defending it. (b) Limits. This applies only to the extent the claim is caused by your Submission. It does not apply to anything Kavi changed or added. (c) Process. Kavi will tell you promptly about the claim. Kavi will not settle it in a way that makes you admit fault without your agreement. (d) Consumer law. This section 13.6 does not apply to the extent the law that protects you as a consumer does not allow it.
13.7 Kavi may remove Submissions. Kavi does not check Submissions before they appear and does not promise to monitor them. Kavi may remove or edit any Submission that breaks these Terms or the law, or that Kavi reasonably believes creates a risk for others. Examples of edits include replacing a profile photo or renaming a playlist.
14. Reporting content; copyright and repeat infringers
14.1 Reporting. Anyone may report content on Kavi, including people who do not use Kavi:
- safety, child-safety, intimate-image and impersonation reports: safety@kavi.audio;
- copyright notices: copyright@kavi.audio (section 14.2);
- trademark, publicity, personality and other rights complaints: rights@kavi.audio; and
- complaints under India's IT Rules: Kavi's Grievance Officer (section 25).
If you come across content you believe sexually exploits a child, report it immediately to safety@kavi.audio. Do not download, copy or share it.
14.2 Copyright notices.
- Kavi responds to notices of claimed copyright infringement under the US Digital Millennium Copyright Act (17 U.S.C. §512) and under its Copyright/DMCA and Repeat-Infringer Policy (kavi.audio/legal/copyright-policy).
- That Policy says what a notice must contain, how to send a counter-notice, and how Kavi handles complaints from India.
- Sections 4 to 8 of that Policy apply to listener accounts and Submissions, as well as to creators' content (section 1.4(b)).
Kavi's designated agent, registered with the US Copyright Office (DMCA-1075495), is:
Copyright Manager Kavi Media, Inc. 169 Madison Ave, STE 30314 New York, NY 10016, USA Telephone: (929) 224-4143 Email: copyright@kavi.audio
14.3 Repeat infringers. Kavi will, in appropriate circumstances, terminate the account of any subscriber or other account holder who is a repeat infringer. This includes listeners.
- As a default, Kavi treats a listener as a repeat infringer if it receives three valid copyright notices about that listener's Submissions within any 12-month period.
- A notice does not count if it was withdrawn, or if it was answered by a valid counter-notice.
- Kavi may act sooner where infringement is clear and willful.
- Before terminating, Kavi tells you why and gives you 14 days to respond. You may ask Kavi to reconsider within 30 days by email to copyright@kavi.audio.
These steps follow the Copyright/DMCA and Repeat-Infringer Policy.
14.4 False notices. A person who knowingly and materially misrepresents that material infringes, or that it was removed by mistake, may be liable for damages.
15. Intimate images and impersonation
15.1 Asking for removal. You may ask Kavi to remove an intimate image or audio of you that was published on Kavi without your consent. This includes AI-generated or morphed images, audio or voice. Someone authorized to act for you may also ask. You can also ask Kavi to remove content that impersonates you. You do not need a Kavi account.
Email safety@kavi.audio (kavi.audio/legal/intimate-image-removal explains the process).
15.2 What a request must include. A valid request is in writing and includes: (a) the physical or electronic signature of the person shown or heard, or of someone authorized to act for them; (b) enough information for Kavi to identify and find the content, for example a link or the name of the profile, playlist or title; (c) a brief statement that the person believes in good faith that the content was published without their consent, with any information that helps Kavi confirm this; and (d) contact details.
For a complaint from India under the IT Rules, Kavi acts on any complaint that identifies the content, even if some of these items are missing.
15.3 What Kavi does.
- Kavi gives each request a reference number.
- It removes or disables access to the content within 48 hours after receiving a valid request. For a complaint from India under the IT Rules about an intimate image or about impersonation, it does so within 2 hours, or within any shorter period the law requires.
- It makes reasonable efforts to remove identical copies.
- It tells you what it did. If it did not remove the content, it tells you why.
15.4 Consequences for the person who posted it. Posting such content is a serious breach of these Terms (section 16.2).
16. Moderation, suspension and termination
16.1 Kavi's discretion. Kavi may decide what appears on the Service. In good faith, it may remove or restrict access to content or Submissions it considers objectionable or in breach of these Terms. Kavi does not promise to monitor everything, and it is not responsible for checking every Submission before it appears.
16.2 When Kavi may suspend or close your account. Kavi may suspend or limit your access, or close your account, if: (a) you seriously or repeatedly break these Terms, including section 11 or 12; (b) you post child sexual abuse material, or non-consensual intimate images or audio, which leads to immediate closure; (c) you are a repeat infringer (section 14.3); (d) Kavi reasonably suspects fraud, payment abuse or manipulation of plays (section 11.1(e)); (e) you are not eligible (section 2); (f) a payment is not made (section 6.8); in that case Kavi limits only your Premium access, not your whole account; or (g) the law, a court or a regulator requires it.
16.3 Notice and reasons. Before Kavi suspends or closes your account, it tells you what it is doing and why, and gives you a chance to respond. Kavi may act first and tell you afterwards in these cases:
- where the law requires immediate action;
- where there is a risk of serious harm to anyone or to the Service; or
- where telling you first would break the law or compromise an investigation.
Kavi tells you which rule it relied on, unless the law prohibits it.
16.4 Appeals. You may ask Kavi to reconsider a decision to remove your Submission or to suspend or close your account. Email legal@kavi.audio within 30 days after Kavi tells you about the decision, and explain why you think it was wrong. If you are in India, you may instead write to the Grievance Officer (section 25).
Kavi reviews the request in good faith. Where practicable, the review is done by someone who was not involved in the original decision. Kavi tells you the outcome and its reasons within 30 days after receiving your request, or within any shorter period the law requires. This section does not apply to a decision about child sexual abuse material.
16.5 You can leave at any time. You may stop using Kavi at any time. You may cancel Premium (section 7) or delete your account (section 17).
16.6 Refunds when your account ends. If Kavi closes your account or ends your Premium subscription, section 8 decides whether a refund is due. Kavi does not refund the unused part of a paid period, except where section 8.1 or the law requires a refund.
16.7 What continues after your account ends. The following continue after your account ends:
- sections 13.4 to 13.6 (submissions);
- sections 20 and 21 (disclaimers and liability);
- section 24 (disputes); and
- any other part of these Terms that by its nature should continue.
17. Account deletion
17.1 How to delete. You can delete your account in the Kavi app's settings. You can also delete an extra profile without deleting the account. For questions, or for help with a deletion request, email privacy@kavi.audio (kavi.audio/legal/privacy-request explains how).
17.2 If your account includes a creator profile. Your account may include a creator profile, meaning a profile linked to an agreement you have signed with Kavi as a creator. If any profile on your account is a creator profile, account deletion in the app does not delete anything, and deleting a creator profile in the app does not delete it. Instead, Kavi emails you to explain how to ask for deletion: by email to privacy@kavi.audio (kavi.audio/legal/privacy-request explains how). This is because your creator agreement, payments and tax records need to be dealt with first.
17.3 What account deletion does. When you delete your account, Kavi: (a) deletes or de-identifies the personal information that identifies you. That includes your sign-in details, your email address, your profile names, photos and bios, your playlist names and covers, and the contact records held by Kavi's email and payment providers. It also includes the email address held in Kavi's recommendation system; (b) keeps a record of how much Free Listening time the account used. That record is kept against a one-way code made from your email address, not the address itself, so that Free Listening cannot be reset (section 4.3); (c) cancels any subscription (section 7.5, which also explains the exception for accounts with a creator profile); and (d) keeps your de-identified listening and engagement history. That means what was played and for how long, likes and other reactions, shows followed, items saved to playlists, and votes. It is kept without your name, email address, photo or contact details, under an internal number, together with these profile details, used for statistics: your full date of birth, gender, time zone and country.
17.4 Why Kavi keeps de-identified history. (a) It is the royalty ledger Kavi uses to pay creators for listening. (b) Kavi uses it to improve recommendations. (c) Kavi may use it to train and evaluate Kavi's own AI models. For people in India, Kavi does this only as Indian law allows (Privacy Policy, section 7.4).
Kavi never sells it, and never gives it to outside AI companies to train their models. Likes, follows and listens from deleted accounts continue to count in totals.
17.5 Other records Kavi keeps.
- Kavi keeps payment, tax and legal records for as long as the law requires.
- Deleted information can remain in Kavi's backups for up to 35 days, until they are overwritten.
17.6 More detail. The Privacy Policy explains exactly what is deleted, what is kept, in what form and for how long. It also explains the privacy rights you have and how to use them.
18. Communications
18.1 Electronic communications. You agree that Kavi may send you notices, confirmations, receipts and other communications about your account and these Terms by email to the address on your account, or through the Service. These communications satisfy any requirement that they be in writing. Keep your email address up to date.
18.2 Service emails. Kavi always sends the emails needed to run your account, even if you have turned off marketing email. These include:
- verification codes;
- subscription confirmations, receipts and reminders;
- notices of changes; and
- responses to your requests.
18.3 Newsletters and content updates. (a) If your account is not identified as being in India (section 2.2 and the Privacy Policy, section 16.4), Kavi signs you up for its newsletter and new-content emails when you create your account or add a profile. (b) If you live in India, Kavi sends them only if you tick the box to receive them. (c) Every marketing email has an unsubscribe link. You can also turn these emails off in the app's notification settings.
The Privacy Policy explains more.
19. Changes to Kavi and to these Terms
19.1 Changes to the Service. Kavi may change, add or remove features, content and plans. Kavi gives notice of changes that matter to you, as this section describes.
19.2 Changes to these Terms. (a) Material changes. For a material change, Kavi emails you and posts a notice on the Service at least 30 days before the change takes effect. The notice includes a summary of what changed. (b) Price and subscription changes. These follow section 9 instead. (c) Shorter notice. Kavi may give shorter notice, or make a change take effect immediately, only where the change is required by law, a court or regulator, an app store or a payment provider, or is needed to deal with an urgent safety, security or fraud risk. Even then, the change goes only as far as that requirement or risk demands, and Kavi explains it as soon as practicable. (d) Changes in your favor. A change in your favor, or a purely administrative change (such as new contact details), may take effect when posted. (e) Earlier disputes. A change never applies to a dispute that arose before it took effect. (f) Past versions. Kavi keeps past versions of these Terms available at kavi.audio/legal/terms.
19.3 If you do not agree to a change.
- If you do not agree to a change, you may cancel Premium or delete your account before it takes effect.
- If Kavi makes a change that materially reduces what Premium includes (for example, starting to play ads Kavi has sold, section 10.4(c)), you may cancel under section 7.
- If Kavi closes the Service altogether, it gives at least 30 days' notice.
- In each case, section 8 decides whether a refund is due.
19.4 Continuing to use Kavi. If you keep using the Service after a change takes effect, the changed Terms apply to you from then on. Changes to section 24.2 (US disputes) work as section 24.2(m) describes.
20. Disclaimers
20.1 The Service is provided "as is". To the fullest extent the law allows, Kavi provides the Service and all Kavi Content "as is" and "as available". It gives no promises or warranties beyond those in these Terms. This includes no implied warranties of merchantability, fitness for a particular purpose or non-infringement. Kavi does not promise that the Service will be uninterrupted, error-free or secure, or that any particular content will be available.
20.2 Your consumer rights are not affected. Some US states do not allow implied warranties to be excluded, so some of section 20.1 may not apply to you. If you live in India, nothing in these Terms limits your rights under the Consumer Protection Act, 2019, including your right to complain about a deficiency in service.
20.3 Other people's content and sites. Kavi is not responsible for:
- products or services promoted by creators' sponsors;
- the content of third-party websites the Service links to; or
- the conduct of other users.
Kavi does not endorse a sponsor because a creator promotes it, even where Kavi put the creator in touch with that sponsor.
21. Limitation of liability
21.1 Indirect loss. To the fullest extent the law allows, Kavi is not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill, arising out of these Terms or the Service.
21.2 Cap. To the fullest extent the law allows, Kavi's total liability to you for all claims arising out of these Terms or the Service is limited to the greater of: (a) the total amount you paid Kavi in the 12 months before the event giving rise to the claim; and (b) US$100 (or its equivalent in Indian rupees, if you live in India).
21.3 What these limits do not cover. Sections 21.1 and 21.2 do not limit or exclude: (a) liability for death or personal injury caused by Kavi's negligence; (b) liability for fraud, gross negligence or willful misconduct; (c) any refund these Terms or the law require Kavi to pay; (d) any liability that the law does not allow to be limited or excluded, including under the consumer-protection or automatic-renewal laws of the US state where you live; or (e) if you live in India, your rights under the Consumer Protection Act, 2019, including to compensation a Consumer Commission orders.
21.4 State-law note. Some US states do not allow incidental or consequential damages to be limited or excluded, so some of these limits may not apply to you.
22. Affiliate and Referral Program
22.1 The Program. Kavi runs an Affiliate and Referral Program on the Rewardful platform. Its terms are the Affiliate and Referral Program Terms (kavi.audio/legal/affiliate-program-terms). Listeners may join.
- A participant earns a commission when someone they referred starts a paid Kavi subscription.
- The referred subscriber gets the discount in section 5.4.
22.2 Referral cookie.
- When you arrive at kavi.audio through a participant's link, Rewardful may set a referral cookie: in the United States unless you turn it off, and elsewhere only if you allow it (see the Cookie Policy).
- The cookie lets Kavi credit that participant if you subscribe within 60 days.
- The participant sees in their dashboard that a referral subscribed and the commission earned (the Privacy Policy, section 8.5, explains what else, if anything, they see). They are never told your listening activity.
The Cookie Policy explains this cookie and your choices.
22.3 Which terms apply. If you join the Program, the Program Terms govern your participation, your commissions and any dispute about them. If you are not a creator or contributor, Kavi handles your Program data under the Privacy Policy. This includes people who hold only a Program account.
23. Signed agreements with Kavi prevail
23.1 You may have signed an agreement with Kavi. That includes any of the following:
- a Creator, Music or Audiobook Master Agreement;
- the Creator Terms — Short-form;
- a guest or cast release;
- an equipment, editing-support, narration or translation agreement;
- an AI-voice consent; or
- the Affiliate and Referral Program Terms.
That agreement governs your content, your payments, your personal data as described in it, and disputes about those matters. If it conflicts with these Terms on those matters, the signed agreement prevails.
23.2 These Terms continue to govern your use of the Service as a listener. That includes your Premium subscription.
24. Disputes
24.1 Which part applies to you.
- If you live in India, section 24.3 applies to you, and section 24.2 does not.
- If you live anywhere else, section 24.2 applies to you.
Where you live is decided on the date the notice of dispute under section 24.2(a) or 24.3(b) is sent. The country on your account is evidence of where you live, but it is not conclusive.
24.2 If you live in the United States
(a) Talk first (60 days).
- Before starting arbitration or a court case, the party with the dispute must send the other a written notice.
- The notice gives the sender's name, the email address on the account, a description of the dispute, and the relief wanted.
- Send yours to legal@kavi.audio or to Kavi's mailing address. Kavi sends its notice to the email address on your account.
- Both sides will then try in good faith to resolve the dispute for 60 days. If either side asks, this includes a call between you and someone at Kavi with authority to settle.
- Time limits for bringing the claim are paused during those 60 days.
- This step does not apply to small-claims cases (section 24.2(e)), or to urgent requests to a court to protect intellectual property (section 24.2(f)).
(b) Governing law. These Terms are governed by the laws of the State of Georgia, USA, and applicable US federal law, without regard to conflict-of-laws rules. The exception is sections 24.2(c) to 24.2(m): the Federal Arbitration Act (9 U.S.C. §1 and following) alone governs their interpretation and enforcement. Nothing in these Terms removes any protection that the consumer laws of the state where you live give you and do not allow to be waived by contract.
(c) Arbitration instead of court.
- You and Kavi each give up the right to have a dispute decided in court by a judge or jury, except as sections 24.2(e), (f), (i), (j) and (k) allow.
- Any dispute arising out of or relating to these Terms or the Service that is not resolved under section 24.2(a) will be resolved by final and binding individual arbitration. That includes disputes about subscriptions, billing, renewal, cancellation and refunds.
- The arbitration is administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (the "Consumer Rules") in force when it starts, as modified by this section 24.2.
- A single arbitrator decides the dispute.
- Where the Consumer Rules provide for it, a claim is decided on written documents. Any hearing is held by video or telephone, or in person in the county where you live, as the Consumer Rules provide.
- The arbitrator may award the same individual relief a court could award, including statutory remedies and attorneys' fees where the law allows them.
- The Consumer Rules are available at adr.org.
(d) Fees.
- You pay only the consumer filing fee that the Consumer Rules set for you, currently US$225.
- Kavi pays every other AAA fee and all arbitrator compensation, as the Consumer Rules require. That includes any fee for reviewing this arbitration clause.
- Each side pays its own legal costs, unless the arbitrator awards them under applicable law.
(e) Small claims. Either party may instead bring an individual claim in a small-claims court that has jurisdiction. That can be in the county where you live or in Fulton County, Georgia.
(f) Intellectual property. Either party may ask a court for urgent interim relief to stop infringement or misuse of its intellectual property while arbitration is pending.
(g) Individual claims only (class action waiver).
- Disputes will be resolved only on an individual basis.
- Neither you nor Kavi may bring, join or take part in any class, collective, consolidated or representative action or arbitration against the other.
- The arbitrator may not combine different people's claims or award relief to anyone other than you and Kavi.
- If several individual cases are assigned to one arbitrator under section 24.2(h), that is not combining claims.
- A court, not an arbitrator, decides any dispute about whether this section 24.2(g) is enforceable.
(h) Mass filings. The AAA may decide that its Mass Arbitration Supplementary Rules apply to a group of demands that includes yours. Those rules currently apply when 25 or more similar demands are filed. If they apply:
- those rules and the AAA's related fee schedule govern, including the appointment of a process arbitrator and the assignment of cases to merits arbitrators;
- Kavi's duty to pay fees under section 24.2(d) applies to the fees charged under that schedule;
- every claim is still heard and decided on its own merits; and
- no claimant is bound by the outcome of anyone else's case.
(i) Claims that cannot be sent to arbitration. Sections 24.2(c) and (g) do not apply to:
- any claim that applicable law does not allow a pre-dispute agreement to send to arbitration or to limit to individual proceedings. That includes, if you choose, a sexual harassment or sexual assault dispute under 9 U.S.C. §§401–402; or
- a request for public injunctive relief under California law.
Such a claim is decided in court. To the extent the law allows, the court case is paused until the individual claims in arbitration are decided.
(j) If the class action waiver fails. If section 24.2(g) is found unenforceable for a claim, that claim alone will be decided in court, never in class, collective or representative arbitration. The rest of this section 24 continues to apply.
(k) Your right to opt out (30 days).
- You may opt out of arbitration under section 24.2(c). To do so, email legal@kavi.audio within 30 days after you first accept these Terms. Give your name and the email address on your account, and say that you opt out of arbitration.
- Opting out has no other effect on these Terms or on how Kavi treats you.
- If you opt out, disputes will be decided by the state or federal courts for the county where you live, or for Fulton County, Georgia, at your choice. Sections 24.2(a), (b), (e), (f) and (g) continue to apply as far as the law allows.
(l) No jury waiver in court. Nothing in these Terms waives your right to a jury trial in any dispute decided in court.
(m) Changes to this section. If Kavi changes this section 24.2, it gives you at least 30 days' notice. You may reject the change by emailing legal@kavi.audio before it takes effect. If you reject it, the version you last accepted continues to apply to you. A change never applies to a claim already filed, or to a dispute already notified under section 24.2(a).
24.3 If you live in India
(a) Governing law. These Terms are governed by the laws of India.
(b) Talk first. You can raise any complaint with Kavi's Grievance Officer (section 25). Kavi will try in good faith to resolve it. You do not have to do this before going to a Consumer Commission or the National Consumer Helpline.
(c) Your consumer rights.
- Nothing in these Terms stops you from filing a complaint before a Consumer Commission under the Consumer Protection Act, 2019. You can file with the District Commission where you live or work for gain, including online through e-Daakhil.
- Nothing in these Terms stops you from contacting the National Consumer Helpline (1915, or consumerhelpline.gov.in).
- No clause in these Terms takes away a Consumer Commission's jurisdiction.
(d) Courts. Subject to section 24.3(c), and to any right the law gives you to bring a case where you live, the courts at Hyderabad, Telangana have jurisdiction over disputes under these Terms.
(e) Optional online arbitration. After a dispute has arisen, you and Kavi may both agree in writing to resolve it by arbitration instead. Either of you may suggest this, and neither is required to agree. If you both agree:
- the arbitration is under the Arbitration and Conciliation Act, 1996, seated in Hyderabad;
- it is administered online by Presolv360 under its Dispute Resolution Rules;
- a sole arbitrator decides it;
- it is conducted in English, with a Telugu interpreter at Kavi's cost if you ask; and
- Kavi pays all arbitrator, institutional and administrative fees.
Kavi will never ask you to agree to arbitration as a condition of using the Service, or of resolving your complaint.
(f) No representative-action waiver. Nothing in this section 24.3 waives any right to bring or join a representative or class proceeding that Indian law gives you.
25. Grievance Officer and customer care
25.1 Grievance Officer. Kavi's Privacy & Grievance Officer receives complaints about the Service. That includes complaints about content, moderation decisions, privacy, billing and refunds. The same person is Kavi's Grievance Officer for India under the IT Rules and the Consumer Protection (E-Commerce) Rules, 2020.
Name: Srihith Pallamreddy Designation: Grievance Officer (India); Privacy & Grievance Officer Kavi Media, Inc., 169 Madison Ave STE 30314, New York, NY 10016, USA Email: privacy@kavi.audio (subject line "Grievance") Phone: +1 (929) 224-4143 Details are also published at kavi.audio/legal/grievance-officer.
25.2 Timelines. (a) Content and moderation complaints. Kavi acknowledges them within 24 hours after receiving them and resolves them within 7 days, or within any shorter period the law requires. For a removal complaint from India under the IT Rules:
- content of a kind described in section 12.1(b) to (i) or (k) to (o) is removed within 36 hours after receiving a valid complaint (or within 2 hours for an intimate image or impersonation, under (b) below); and
- a complaint under section 12.1(a), (j) or (p) (content that belongs to someone else, infringes a copyright, trademark or patent, or breaks another law) is resolved within 7 days. Copyright complaints follow the Copyright/DMCA and Repeat-Infringer Policy. (b) Intimate images and impersonation. From anywhere, Kavi removes or disables access to the content within 48 hours after a valid request. For a complaint from India under the IT Rules, it does so within 2 hours (section 15.3). (c) Other complaints, including billing, subscription, cancellation, refund and other consumer complaints. Kavi acknowledges them within 24 hours after receiving them and resolves them within 15 days. (d) Privacy requests and privacy grievances. Kavi acknowledges them promptly and responds within the time the law that applies to you requires (Privacy Policy, section 18.5). (e) If the law sets a shorter period for any complaint, Kavi meets it. Kavi tells you the outcome and its reasons in writing. (f) Appeal (India). For a decision on a complaint under the IT Rules, you may appeal to the Grievance Appellate Committee (gac.gov.in) within 30 days after the decision.
25.3 Customer care. For help with your account or subscription, email contact@kavi.audio or call +1 (929) 224-4143.
26. General
26.1 The whole agreement. These Terms, together with the documents listed in section 1.4(a) and (b), are the whole agreement between you and Kavi about your use of the Service as a listener. They replace any earlier statement about it. This is subject to section 23 (signed agreements prevail). Nothing in this section limits liability for fraud.
26.2 Transfer. You may not transfer your account or your rights under these Terms. Kavi may transfer these Terms to a company that takes over the Service, or the part of Kavi's business that runs it. If it does, it will tell you, and your rights under these Terms will not be reduced.
26.3 If part of these Terms is invalid. If a court or arbitrator finds part of these Terms unenforceable, the rest continues in force. The exception is section 24.2(j), which says what happens if the class action waiver fails.
26.4 No waiver. If Kavi does not enforce a right straight away, it has not given that right up.
26.5 Events outside Kavi's control. Kavi is not responsible for a failure or delay caused by events outside its reasonable control, such as a power, internet or cloud-provider outage, natural disaster or government action. This does not affect any refund due under these Terms.
26.6 Apple and Google. (a) If you use a Kavi app downloaded from the Apple App Store or Google Play, these Terms are between you and Kavi, not Apple or Google. (b) Kavi alone is responsible for the app, its content, support and maintenance, and any claim about it. That includes product, consumer-protection and intellectual-property claims. (c) Apple and Google have no obligation to provide support for the app. (d) If the app fails to meet any warranty that applies, you may notify Apple, and Apple may refund the purchase price of the app, if any. Apple has no other warranty obligation to the extent the law allows. (e) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. (f) You must also follow the store's own terms of use.
26.7 Sanctions. You confirm that you are not on any US government list of prohibited or restricted parties, and that you are not located in a country subject to a US government embargo.
26.8 Third-party services. Payment providers such as Stripe, and app stores, have their own terms and privacy policies. These apply when you use them.
